Please read this agreement carefully, all members of finditcomo.com will be held responsible for following guidelines established by this document.
Acceptance of Terms
By registering with finditcomo.com, you agree to the terms of this Member and Privacy Agreement, and to abide by the other terms, policies, procedures, and guidelines on finditcomo.com. At anytime finditcomo.com may amend these terms to further secure our Mission. If you do not agree to the changes, please email us so we can delete your account. If you continue to utilize finditcomo.com, then it will be understood that you accept all updated conditions and terms of use.
Finditcomo.com Mission:
To provide a forum where individuals and businesses can find and sell things locally without the worry of fraud, shipping costs, non paying sellers/buyers, or paying large amounts of money just to advertise their items. A forum created to build relationships within communities that benefit each individual as well as businesses and organizations within that community.
Finditcomo.com is a Service
Finditcomo.com is a service for Members to post things/services they have that may be of use to people in their area. Finditcomo.com does not handle any of the goods and services listed on the site. Because of not handling any goods/services, we cannot be sure of the level of safety, quality, and truthfulness of any ad or item. In addition to not being affiliated with any good or service, we do promote the transfer of any funds between members for any good or service. If members choose to transfer funds between themselves, they do so at their own risk and with the understanding that they are putting themselves at risk of fraud or piracy.
Eligibility of being a Member of finditcomo.com
To register as a member of finditcomo.com, it is understood that you must:
* Be a legal and permanent citizen of the United States or Canada.
* Provide finditcomo.com with an email address that is a valid and that will serve as a tool of communication with you. The email address provided must be updated on a regular basis.
* Provide finditcomo.com contact information is accurate and complete, including but not limited to your month and year of birth, your full name, city, state, postal code, and email address.
* Register only one account per individual/business. If you register yourself as a business, you must have the authority to bind the business to the Member and Privacy Agreement.
Finditcomo.com may, under its sole discretion, terminate any membership account at any time. If and when finditcomo.com determines that your membership account must be deleted, all of your account information may not be sold to any party or transferred unless finditcomo.com itself is acquired by another company. If finditcomo.com is acquired by another company, they may only use your account information in affiliation with finditcomo.com activities.
Member Sign-up Names
Finditcomo.com may, at it sole discretion, change or remove any member sign-up name. Any name that represents anything that may be inappropriate or offensive to any current or future Members of finditcomo.com may not be used and will be removed by finditcomo.com administration. If there is any question on whether or not a sign-up name is unacceptable please contact finditcomo.com directly.
Member Obligations and Terms
You and only you are responsible for your information, and finditcomo.com acts only as a third party forum for the publication of the information you would like to provide your area. Your responsibilities include all information you provide to finditcomo.com during the registration, when you post a listing, post in public message area or through any email feature, including all text descriptions and/or photographs, digital images, or renderings of your items and services. If at anytime finditcomo.com feels that any information that you provide may create a liability for us, we will take action against you that may include but is not limited to removing all of your content as well as deleting your account. Finditcomo.com does not pre-screen any information that is given by its members, but we do reserve the right to edit, block, delete, or restructure any information that is provided by any members of finditcomo.com. In addition to that right, we also reserve the right to modify any of the services we provide at anytime.
Member Provided Content.
All information/content provided by every member of finditcomo.com must:
* Be current. No information may be provided that does not apply to the present time.
* Be true. No information may be provided that isn’t factual and is known by each member’s personal knowledge to be 100 % true.
* Be free of any fraudulent claims.
* Not involve any stolen items or be affiliated with any broken regulation, ordinance, or any law which is provided by city, state, or federal government.
* Be free of any harassment, threat, racism, sexism, obscenity, computer viruses, child pornography, or any other material that is deemed inappropriate by the common public.
* Be free of any links to any other forums that violate the Member and Privacy Agreement
Member Posting Process
Classified ads or listings on finditcomo.com are a combination of text descriptions, graphics, and/or pictures supplied by each individual member that either (a) describe a good or service you have or provide (b) describe a good or service item you are seeking. Whether it is a good or service, to provide the item on finditcomo.com you must place the item in the appropriate category for that item or service.
Advertising ads provided by any member do represent beliefs or opinions of anyone at finditcomo.com. Finditcomo.com is not responsible for the accuracy or content of any posting or advertising ad. All classifieds are subject to approval by finditcomo.com administration.
Fees. Unless otherwise stated, all monetary values are quoted in U.S. Dollars. You are responsible for paying all applicable fees, taxes and duties and for all costs you incur as part of the finditcomo.com service. We may, at our sole discretion, change some or all of our services, and our fees and payments policies.
Member to Member Conflicts
Finditcomo.com is not responsible for resolving disputes between members. Because no money is to trade hands through finditcomo.com, all members should be cautious in any attempts for anyone to sell something by requesting for money through wire transfer or any other electronic fund transferring service. All transactions should be made face to face within each member’s area, thus avoiding any fraudulent attempts to steal money from individuals.
Member Privacy
Any information you provide finditcomo.com when you sign up will not be sold or given to outside sources without your permission. Finditcomo.com uses the information we collect in order to provide you with the most effective way to sell or find things within your area respectively.
In order to post items or advertise on finditcomo.com, you must become a finditcomo.com member. It is completely free. The registration process requires that you provide your full name, street address, email address, and other identifying information.
In an effort to facilitate a trusting buying and selling community, we provide you with the option to submit pictures and/or a description of your item or service. When you post your classified ad on finditcomo.com, the ad description and pictures are displayed on the site and accessible to visitors on finditcomo.com. We will not post lewd, nude, or semi-nude photos, so please do not upload them. If such photos are uploaded, they will be removed immediately. Classifieds and photos are subject to approval and must meet our Ad Posting Policy.
Finditcomo.com uses cookies to provide you access to protected pages without requesting a login each time. Cookies are small files that are placed on your computer when you visit our site. Our web site will reference and update the cookie each time you visit finditcomo.com. We use cookies to deliver content specific to you, and only within your immediate area. If you would like to search outside of your area, you are free to do so, but we do not recommend it.
The information that you provide when you post a classified ad is posted in public areas and available to all visitors. Please remember that any information that is disclosed in these areas becomes public information, so please exercise caution. This site has security measures in place to protect the loss, misuse, and alteration of the information under our control. All member data and activity is stored separately and is not directly accessible through a web browser. We use industry standard procedures and processes to safeguard the confidentiality of your identifiable personal information, such as firewalls, encryption, token authentication, monitoring technology, and adaptive analysis of network traffic to track abuse of our network and its data. Unfortunately, when you submit information about yourself to finditcomo.com over the Internet, the information may travel over many systems that are not under the control of finditcomo.com. The Internet is not 100% secure and others might intercept the information that you are sending. Remember that your account is accessible only through the use of your password. If any problem occurs with your account, do not hesitate to change your password immediately.
Our priority is to keep your personal information private and confidential. Finditcomo.com will not willfully disclose, rent, or sell your personal information to third parties. However, certain personal information will be available to others in the process of using finditcomo.com. For example, visitors to finditcomo.com may view your sign-in name, city, and items you have for sale.
Of course, once you provide personal information to a buyer or seller, finditcomo.com has no control over how that information might be used by that individual. To avoid unwanted calls or emails, finditcomo.com allows the Seller to choose how they would like to be contacted about their item, whether it is solely by email or phone.
Finditcomo.com may choose to disclose your personally identifiable information to others under the following circumstances:
* You provide us with permission to consent to share your information to outside parties.
* In response to a criminal investigation, subpoena, court order or legal process.
* Your actions on finditcomo.com appear to be in violation of our Membership and Privacy Agreement or Ad Posting Policy
* You post a listing which we believe, in our sole discretion, may create a liability for finditcomo.com.
Nothing in this policy shall limit, prohibit, or otherwise deny the ability of finditcomo.com to (1) transfer, assign, or sell our assets to a third party without limitation, or (2) dispose of our assets in any manner, through bankruptcy or similar proceeding. In addition, finditcomo.com makes no warranties or claims regarding the accuracy or completeness of the information we collect and disclose through our site, and disclaims any liability regarding its use.
Finditcomo.com System
You agree that you will not use any device, software, or routine to interfere or attempt to interfere with the proper working of the finditcomo.com site or any transaction being conducted on our site. You may not take any action which imposes an unreasonable or disproportionately large load on our infrastructure. You may not disclose or share your Password to any third parties or use your Password for any unauthorized purpose.
Finditcomo.com will conduct scheduled preventative as well as autonomous maintenance of the site. As a result, you may experience temporary downtime that may prevent you from being able to post or view content or use our services on finditcomo.com. These inconveniences are necessary in order for us to continually improve our services as well as databases and technologies. We will do our best to keep site downtime to a bare minimum and to provide advance notice whenever that is a possibility.
General Legal Terms
Our service is provided "as is." We will try very hard to make your experience with finditcomo.com a pleasurable one; however, we cannot always foresee or anticipate technical or other difficulties. These difficulties may result in loss of data or other service interruptions. These terms are also noted in Posting Policy. For this reason, you agree that finditcomo.com's services are provided "as is." We cannot assume responsibility for the timeliness, deletion, mis-delivery, or failure to store any Member data, communications, or personalization settings. WE AND OUR SUPPLIERS PROVIDE THE finditcomo.com WEBSITE AND OUR SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS OR IMPLIED. WE AND OUR SUPPLIERS SPECIFICALLY DISCLAIM THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights and you may also have other legal rights which vary from state to state.
Suspension or termination of accounts. We may immediately issue a warning, temporarily suspend, indefinitely suspend, or terminate your membership, any of your current listings, and any other information you place on finditcomo.com that violates the Membership and Privacy Agreement or if we are unable to verify or authenticate any information you provide to us. Without limiting any other remedies, finditcomo.com may suspend or terminate your account if you are found (by conviction, settlement, insurance or escrow investigation, or otherwise) to have engaged in fraudulent activity in connection with our site.
Limit of liability. IN NO EVENT SHALL WE OR OUR SUPPLIERS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (HOWEVER ARISING, INCLUDING NEGLIGENCE) ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT. OUR LIABILITY, AND THE LIABILITY OF OUR SUPPLIERS, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO THE GREATER OF (A) THE AMOUNT OF FEES YOU PAY TO US IN THE 12 MONTHS PRIOR TO THE ACTION GIVING RISE TO LIABILITY, OR (B) $100. Some states do not allow the limitation of liability, so the foregoing limitation may not apply to you.
General compliance with laws. You shall comply with all applicable laws, statutes, ordinances and regulations regarding your use of our service and your negotiations, classified ad, purchase, and sale of items and services.
No agency. You and finditcomo.com are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by the Membership and Privacy Agreement.
Notices. Except as explicitly stated otherwise, finditcomo.com may provide you with notices via email, regular postal mail, or postings on the finditcomo.com web site.
Arbitration. Any controversy or claim arising out of or relating to this agreement shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of Missouri, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Either you or finditcomo.com may seek any interim or preliminary relief from a court of competent jurisdiction in the State of Missouri necessary to protect rights or property pending the completion of arbitration.
Jurisdiction and Venue. This Agreement shall be governed in all respects by the laws of the State of Missouri. You agree that any legal action brought against finditcomo.com, of which is owned by Charlie Gray, LLC, shall be governed by the laws of the State of Missouri without regard to its conflict of law principles, and that the sole jurisdiction and venue for any litigation arising from your use of finditcomo.com shall be an appropriate federal or state court located in the State of Missouri. If any provision of this agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe, or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.
Other Agreements. If you and finditcomo.com have entered into a separate written agreement that covers your use of finditcomo.com, the terms and conditions of such agreement shall control to the extent they are inconsistent with this agreement.
By utilizing this site in any manner, you accept both the terms and conditions in this Membership and Privacy Agreement and our terms of use.
